Archmage Software Chat Terms of Use
Please read these Terms carefully. By selecting “I Agree & Enter Chat,” you confirm that you have read, understood, and agree to be legally bound by them.
1. Eligibility
You must be at least 13 years old, or the minimum legal age required in your jurisdiction. If you are under the age of legal majority where you live, you represent that a parent or legal guardian has authorized your use of the Service.
2. No Expectation of Privacy
Chat messages and account activity may be logged, retained, reviewed, moderated, and disclosed when reasonably necessary to operate and protect the Service or when required by law. Do not submit confidential, financial, medical, authentication, or other sensitive information.
3. Acceptable Use
You may not use the Service to harass, threaten, exploit, defraud, impersonate, spam, distribute malware, interfere with systems, evade access controls, coordinate unlawful conduct, or publish content that is illegal or violates another person’s rights.
4. User Content
You remain responsible for content you submit. You grant Archmage Software a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, moderate, and remove that content as reasonably necessary to operate, secure, and improve the Service.
5. Other Users and No Reliance
Chat content is supplied by users and is not endorsed, verified, or guaranteed by Archmage Software. It may be inaccurate, offensive, harmful, or misleading. You use and rely on user content at your own risk.
6. Moderation and Enforcement
Archmage Software may investigate activity; remove content; restrict features; close rooms; mute, suspend, or terminate users; and preserve relevant records at its sole discretion, with or without prior notice. No appeal process is guaranteed.
7. Intellectual Property
Do not post material unless you have the right to share it. Repeated or serious infringement may result in removal or termination. Copyright concerns may be reported through the contact method published by Archmage Software.
8. Service Availability and Changes
The Service may be changed, interrupted, limited, or discontinued at any time. No availability, retention, compatibility, or data-recovery commitment is made.
9. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ARCHMAGE SOFTWARE AND ITS OWNERS, OPERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, REVENUE, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICE.
11. Indemnification
You agree to defend, indemnify, and hold harmless Archmage Software and its owners, operators, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from your content, conduct, use of the Service, violation of these Terms, or infringement of another person’s rights.
12. Suspension and Termination
Your access may be restricted or terminated at any time for suspected abuse, risk to the Service or its users, violation of these Terms, or any other lawful reason.
13. Changes to These Terms
Archmage Software may revise these Terms. When a new version requires acceptance, you must accept it before entering a chat room. Continued use after notice of revised Terms constitutes acceptance where permitted by law.
14. Severability and Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms constitute the agreement between you and Archmage Software regarding the Service, except for any separate written agreement that expressly applies.
15. Acknowledgment
By accepting, you confirm that you have had an opportunity to review these Terms, understand them, and voluntarily agree to be bound by them.
